Terms of Service — Yournal

These Terms of Service ("Terms") govern your use of Yournal, a daily journaling application published by Propsy Digital Sp. z o.o. ("Propsy Digital", "we", "our"). By downloading or using Yournal, you agree to be bound by these Terms. If you do not agree, please do not use the application.

1. Who We Are

Propsy Digital Sp. z o.o. is a limited liability company registered in Poland, with its registered office at ul. Marsz. Józefa Piłsudskiego 74/320, 50-020 Wrocław, Poland (KRS: 0001158753, NIP: 8971950004, REGON: 541052080).

2. What Yournal Is

Yournal is a personal journaling application that allows you to:

  • Record daily entries, moods, and activities.
  • Receive AI-generated reflections, mood summaries, and pattern reports.
  • Optionally sync your journal across multiple devices via a cloud account.

Yournal is designed as a personal reflection tool. It is not a medical, psychological, psychiatric, or therapeutic service, and nothing within the application should be interpreted as professional advice of any kind. If you are experiencing a mental health crisis or thoughts of self-harm, please contact a qualified professional or emergency services in your country.

The application is currently available on Android. iOS and desktop versions are planned for future release.

3. User Accounts

3.1 Account-Free Use

Yournal may be used without creating an account. In this case, your journal entries — meaning the written text of your daily notes — are stored exclusively on your device and are never transmitted to our servers.

However, even when you use Yournal without an account, certain limited data is transmitted to our servers in order to provide the service:

  • Mood, emotion, and activity tags that you record are transmitted to our backend for storage and processing.
  • Content submitted to AI features (see Section 5) is transmitted for processing each time you use such a feature.
  • Anonymous technical and usage data required to operate the service (e.g. number of AI requests used in a given month, to enforce free-tier limits).

Detailed information on what data is collected, how it is processed, and your rights regarding that data is provided in our Privacy Policy.

3.2 Creating an Account

Creating an account is optional and enables:

  • Cloud synchronisation of your full journal (including entries) across multiple devices.
  • Access to your data from future versions of Yournal (iOS, desktop).
  • Management of your Premium subscription and purchased AI usage.

To create an account, you must provide a valid email address and a password. You are responsible for keeping your credentials secure and for all activity that occurs under your account.

3.3 Minimum Age

You must be at least 13 years old to use Yournal. If you are under 16 and located in the European Economic Area, you must have verifiable parental or guardian consent before creating an account or otherwise using features that involve transmission of data to our servers.

3.4 Deleting Your Account

You may delete your account at any time through the app settings or by emailing privacy@propsydigital.com. Upon deletion, all your data stored on our servers will be permanently removed within 30 days, except where retention is required by applicable law (e.g. accounting records related to past purchases). Data stored locally on your device is not affected by account deletion and must be removed by uninstalling the app.

4. Free and Premium Features

4.1 Free Tier

Yournal is free to download and use. Core journaling features — writing entries, tagging moods, emotions and activities, and viewing your journal history — are available at no charge and will remain so regardless of your subscription status.

4.2 Free Tier AI Usage Limits

AI-powered features (see Section 5) are available to all users on a limited basis. Each calendar month, every user receives a free allowance of AI requests. Once you exceed this allowance, AI features will be unavailable until:

  • the start of the next calendar month, when your free allowance resets; or
  • you purchase Yournal Premium or additional AI usage (see Section 4.3).

The exact size of the free allowance is displayed within the application and may be adjusted as we develop the product.

4.3 Yournal Premium and Additional Purchases

You may extend your access to AI features by:

  • Purchasing a Yournal Premium subscription, which provides a substantially higher monthly AI usage allowance and may include additional features we introduce in future Premium tiers; or
  • Purchasing additional AI usage as a one-off top-up that supplements your current allowance.

The specific features, allowances, and prices included in each option are displayed within the application at the point of purchase and may be updated as we develop the product.

4.4 Your Content Is Always Yours

Downgrading from Premium to the Free Tier — whether by cancelling a subscription, choosing not to renew, or exhausting purchased AI usage — does not result in any loss of, restriction of access to, or modification of journal entries or other content you have created. Your writing belongs to you, unconditionally.

4.5 Pricing

Current pricing for Yournal Premium and any AI usage top-ups is displayed at the point of purchase within the application or on the relevant app store product page. Prices may vary by region and currency. We reserve the right to change pricing at any time; any change will not affect the price of a billing period for which you have already been charged.

4.6 How to Purchase

Premium subscriptions and AI usage top-ups may be purchased through:

  • Google Play in-app purchase (currently available);
  • Apple App Store in-app purchase (future);
  • Propsy Digital's own subscription platform (future), as permitted under applicable platform policies.

4.7 Billing and Automatic Renewal

Subscriptions are billed on a recurring basis for the period you select (e.g. monthly or annual) and renew automatically unless cancelled before the renewal date. You will receive renewal reminders in accordance with the policy of the platform through which you subscribed. One-off AI usage top-ups are not recurring and are billed only once per purchase.

4.8 Cancellation

You may cancel a Premium subscription at any time through the platform through which you subscribed (Google Play account settings, App Store account settings, or our own platform). Cancellation takes effect at the end of the current billing period. You retain access to Premium features until that date. One-off AI usage top-ups cannot be cancelled once consumed.

4.9 Right of Withdrawal (EU/EEA Consumers) and Refunds

4.9.1 Statutory right of withdrawal

If you are a consumer resident in the European Union or European Economic Area, you have a statutory right under Directive 2011/83/EU and, where applicable, the Polish Act on Consumer Rights of 30 May 2014, to withdraw from a distance contract within 14 days of its conclusion, without giving any reason.

4.9.2 Loss of the right of withdrawal — express consent

Yournal Premium subscriptions and AI usage top-ups consist in the supply of digital content not delivered on a tangible medium. In accordance with Art. 38 sec. 1 point 13 of the Polish Act on Consumer Rights (implementing Art. 16 lit. (m) of Directive 2011/83/EU), the right of withdrawal does not apply if:

  1. performance of the contract has begun with your express prior consent before the 14-day withdrawal period has expired, and
  2. you have acknowledged that you thereby lose your right of withdrawal.

By completing a purchase of Yournal Premium or AI usage and confirming the relevant consent at the point of purchase, you (i) expressly request that we begin providing the digital content immediately and before the 14-day withdrawal period expires, and (ii) acknowledge that you thereby lose your right of withdrawal under Art. 27 of the Polish Act on Consumer Rights.

If you do not provide such consent at the point of purchase, the right of withdrawal applies in accordance with the law, and you may exercise it by contacting us at legal@propsydigital.com within 14 days of purchase.

4.9.3 Refunds

Purchases made through Google Play or the Apple App Store are also subject to that platform's own refund policy, which may grant you additional rights beyond those provided by law. Such requests should be directed to the relevant platform.

For purchases made through Propsy Digital's own platform (when available), refund requests may be sent to legal@propsydigital.com.

Nothing in this section limits any non-waivable consumer rights you may have under applicable mandatory law.

5. AI Features

5.1 How AI Features Work

When you use AI-powered features in Yournal, the content of relevant journal entries and/or your mood, emotion and activity tags is transmitted to AI processing infrastructure — either our own servers or third-party AI model providers (such as Anthropic or OpenAI) — solely to generate the requested output (summary, reflection, insight, or report). The result is then returned to you and, if you have an account with cloud sync enabled, may be stored together with your journal.

AI features are an optional part of the service. You can use Yournal as a journaling app without ever invoking them.

5.2 No Training on Your Data

We do not use the content of your journal entries, mood data, emotion data or activity data to train AI models, whether our own or those of any third-party provider. We contractually require our AI providers not to use your content for training their models.

5.3 Nature of AI Output

AI-generated content in Yournal — including mood summaries, reflections, insights, and pattern reports — is generated automatically based on the content you provide. It is intended for personal reflection only.

It does not constitute medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment, and should not be relied upon as such. AI output may be inaccurate, incomplete, or misleading. If you are experiencing mental health difficulties, please seek support from a qualified professional. In an emergency, contact local emergency services.

You are solely responsible for any decisions you make based on AI-generated output.

6. Your Content

6.1 Ownership

You retain full ownership of all journal entries, mood data, emotion data, activity data, and any other content you create in Yournal ("Your Content"). We make no claim to it.

6.2 Licence to Us

By using Yournal, you grant Propsy Digital a limited, non-exclusive, royalty-free, revocable licence to store, process, and transmit Your Content solely for the purpose of operating the service — including local storage, cloud sync (if enabled), enforcement of usage limits, and AI feature processing as described in Section 5. This licence terminates automatically when you delete the relevant content or your account.

6.3 Content Responsibility

You are solely responsible for Your Content. Yournal is intended for personal, private use. You should not enter into Yournal any information that you do not have the right to record, including information about third parties that they have not consented to being recorded.

6.4 Data Export

You may export your data through the in-app export function. Exported data is provided in a structured, commonly used and machine-readable format, in accordance with your rights under applicable data protection law.

6.5 Feedback

If you choose to provide us with suggestions, ideas, feedback, or proposals regarding Yournal ("Feedback"), you agree that we may use such Feedback for any purpose, including to improve the service, without any obligation to compensate you and without restriction. This does not affect your ownership of Your Content as described in Section 6.1; it applies only to suggestions about the application itself.

7. Prohibited Use

You agree not to:

  • Use Yournal for any unlawful purpose or in violation of any applicable law.
  • Use Yournal to enter, store, or process content that is illegal, infringes the rights of others, or that you are not authorised to record.
  • Attempt to reverse engineer, decompile, disassemble, or extract the source code of the application, except to the extent such restriction is prohibited by applicable law.
  • Transfer, redistribute, sublicense, sell, lease, or otherwise make Yournal available to any third party, or make the application available over a network where it could be used by multiple devices simultaneously for commercial purposes, without our prior written consent.
  • Attempt to gain unauthorised access to our servers, databases, infrastructure, or other users' data.
  • Use the application in any way that could damage, disable, overburden, or impair its performance, or interfere with any other party's use of it.
  • Circumvent or attempt to bypass any feature limits, usage allowances, billing mechanisms, or access controls.
  • Use Yournal to generate, store, or distribute content that exploits or harms minors, promotes violence or self-harm, or violates the content policies of our AI providers.
  • Use automated means (bots, scrapers) to interact with the application or its backend services.

You also represent and warrant that you are not located in, ordinarily resident in, or a citizen of any country or territory subject to comprehensive economic sanctions or embargoes imposed by the European Union, the United Nations, the United States Government, or other applicable authorities (currently including, but not limited to, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not listed on any applicable list of sanctioned or restricted persons, including the U.S. Treasury Department's Specially Designated Nationals (SDN) List, the U.S. Department of Commerce's Denied Persons List or Entity List, or any equivalent EU or UN list. You may not use Yournal in violation of any applicable export control or sanctions law, nor for any purpose prohibited by such law, including the development, design, manufacture, or production of nuclear, chemical, biological, or missile weapons.

We reserve the right to suspend or terminate access to the service for users who violate these provisions.

8. Intellectual Property

8.1 Our Rights

All software, design, branding, trademarks (including the "Yournal" name and logo, whether registered or unregistered), and content of Yournal and propsydigital.com are the exclusive property of Propsy Digital Sp. z o.o. or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the application on your personal device(s) in accordance with these Terms. No rights are granted by implication.

8.2 Copyright Complaints (DMCA Notice and Takedown)

We respect the intellectual property rights of others and expect our users to do the same. If you are a copyright owner or authorised to act on behalf of one, and you believe that content made available through Yournal infringes your copyright, you may submit a notice of claimed infringement pursuant to the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) by contacting our designated agent at legal@propsydigital.com.

To be effective, your notice must include:

  • a physical or electronic signature of the copyright owner or authorised representative;
  • identification of the copyrighted work claimed to have been infringed;
  • identification of the material that is claimed to be infringing and information reasonably sufficient to enable us to locate it;
  • your contact information (address, telephone number, and email);
  • a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  • a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner.

We will respond to valid notices in accordance with the DMCA. Users whose content is removed will be notified and may submit a counter-notification. We may, in appropriate circumstances and at our discretion, terminate the accounts of users who are repeat infringers.

Outside the United States, equivalent claims may be submitted under applicable local law, including Directive (EU) 2019/790 and the Polish Act on Copyright and Related Rights, using the same contact address.

9. Third-Party Services

Yournal relies on third-party services to operate, including but not limited to:

  • Google Play — distribution and payment processing;
  • AI model providers (e.g. Anthropic, OpenAI) — processing of AI feature requests as described in Section 5;
  • Cloud infrastructure providers — hosting of backend services and (if you have an account) your synced data.

Your use of these services through Yournal may also be subject to their respective terms. We are not responsible for the practices of third-party services beyond what is described in our Privacy Policy.

10. Availability and Changes to the Service

We aim to keep Yournal available and functioning at all times, but we do not guarantee uninterrupted availability. We may need to temporarily suspend the service for maintenance, updates, or reasons beyond our reasonable control.

We reserve the right to update, modify, add or discontinue features with reasonable notice. We will not remove core free journaling features without giving you adequate time — at least 30 days — to export your data through the export function described in Section 6.4.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Yournal is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the application will be error-free, uninterrupted, secure, or that AI-generated output will be accurate, complete, or suitable for any particular purpose. Use of the application is at your own risk.

Nothing in this Section limits any non-waivable warranties or remedies you may have under applicable consumer law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Propsy Digital, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or other intangible losses, arising from or in connection with Yournal, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any and all claims arising out of or in connection with these Terms or your use of Yournal shall not exceed the greater of: (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) 50 PLN.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable mandatory law, including:

  • liability for damage caused intentionally or by gross negligence;
  • liability for death or personal injury caused by our negligence;
  • non-waivable rights you may have as a consumer under the laws of your country of residence.

13. Indemnification

You agree to indemnify and hold harmless Propsy Digital and its representatives from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the application, or your violation of any law or the rights of any third party. This Section does not apply to consumers to the extent prohibited by mandatory consumer law.

14. Changes to These Terms

We may update these Terms from time to time. Each version is identified by the "Last updated" date at the top of this document.

When we make material changes, we will notify you in the following way, depending on how you use the application:

  • If you have a registered account, we will send a notification to your registered email address at least 14 days before the changes take effect.
  • If you use Yournal without an account, we will display a notice within the application the next time you open it after the changes have been made. You will be asked to acknowledge the updated Terms before continuing to use the app. This in-app notice will be shown regardless of whether you have installed an app update.

In both cases, continued use of Yournal after the effective date of the updated Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you should stop using the application and, if applicable, delete your account in accordance with Section 3.4.

Where required by mandatory consumer law, material changes affecting subscribers will not take effect until your next renewal, or you will be offered the right to cancel without penalty.

15. Termination

We may suspend or terminate your access to Yournal at any time, with or without notice, if you materially breach these Terms, if required by law, or if we discontinue the service. Upon termination, the licence granted to you in Section 8 terminates, and you must stop using the application.

Sections that by their nature should survive termination (including Sections 6.1, 8, 11, 12, 13, 16, and 17) shall survive.

16. Governing Law and Disputes

These Terms are governed by the laws of Poland, without prejudice to any mandatory consumer protection laws of your country of residence that would apply regardless.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Wrocław, Poland, except that if you are a consumer, you may also bring proceedings in the courts of your country of residence, and we may only bring proceedings against you in those courts.

If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not, however, obliged to participate in alternative dispute resolution before a consumer arbitration body.

17. Miscellaneous

  • Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force.
  • No waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
  • Entire agreement. These Terms, together with our Privacy Policy and any in-app purchase terms displayed at the point of purchase, constitute the entire agreement between you and Propsy Digital regarding Yournal.
  • Assignment. You may not assign or transfer your rights under these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
  • Language. These Terms are drafted in English. Any translation is provided for convenience only; in case of conflict, the English version prevails, except where mandatory law of your country of residence requires otherwise.
